## FAQ

### What is the 48-hour SOA rule for Medicare agents?

For marketing appointments scheduled in advance, CMS requires the Scope of Appointment to be obtained at least 48 hours before the appointment. Beneficiary-initiated walk-ins, inbound calls where the beneficiary is ready to proceed, and end-of-enrollment-window situations may complete the SOA at the time of the appointment, provided the exception is documented.

### How long do you have to keep Scope of Appointment forms?

Ten years. Retention applies even if the appointment is canceled, no sale occurs, or the beneficiary enrolls elsewhere. Recordings, enrollment applications, and related documentation carry the same 10-year requirement.

### Do you need a new SOA for a different product type?

Yes. The SOA only covers the product types the beneficiary agreed to discuss. If the conversation moves to a product type not listed, you need a new SOA before discussing it.

### Are Medicare sales calls required to be recorded?

Yes. Medicare Advantage and Part D sales, marketing, and enrollment calls must be recorded in their entirety and retained for 10 years, including virtual appointments. Recording disclosure and applicable state consent law apply on top of the CMS requirement.

### What certifications do Medicare agents need each year?

AHIP Medicare training or an approved equivalent, plus product certification for each carrier you are appointed with, an active state license with completed CE, and E&O coverage. Ready-to-sell status must be confirmed per carrier before AEP begins.

### Can you take an SOA the same day as the appointment?

Only in documented exception cases: the beneficiary walks in, initiates an inbound call and is ready to proceed, or an enrollment deadline makes a 48-hour wait impractical. Document the reason and retain it with the SOA.

### How can an agent automate SOA compliance?

Use a CRM that sends timestamped remote SOA signature links, enforces the 48-hour window on scheduled appointments, records and transcribes every call, retains records for 10 years, and tracks AHIP, carrier certification, license, CE, and E&O deadlines. unLocked CRM includes all of it at a flat monthly price.
