# Scope of Appointment (SOA) Explained: 2026 CMS Rules, Templates, and Compliance

## TL;DR

A Scope of Appointment (SOA) is a CMS-required form that documents which Medicare products a beneficiary has agreed to discuss before a sales appointment. The 2026 CMS rules require a 48-hour advance window, 12-month retention, and a 48-hour purge for unsold SOAs.

## Key data points

- CMS requires the Scope of Appointment to be completed at least 48 hours before any Medicare sales appointment under the 2026 Medicare Communications and Marketing Guidelines.
- Every Scope of Appointment must be retained for 12 months — even if no sale occurs — and unsold SOAs must be purged within 48 hours of the cycle window closing.

The **Scope of Appointment (SOA)** is the most-misunderstood compliance document in Medicare sales. CMS requires it before any personal marketing appointment with a Medicare beneficiary — and the 2026 marketing rule update tightened the timing, retention, and documentation requirements significantly.

## What Is a Scope of Appointment?

A Scope of Appointment is a written or recorded agreement, signed by a Medicare beneficiary before a sales meeting, that documents:
- Which Medicare product types the agent is permitted to discuss (MA, MAPD, PDP, MedSupp, DSNP, etc.)
- The agent's name, NPN, and contact information
- The date and method of the upcoming appointment
- The beneficiary's signature (or recorded verbal consent)

CMS requires the SOA to be completed **at least 48 hours before** the sales appointment, except in narrow walk-in or same-day scenarios.

## 2026 CMS SOA Rule Changes

The 2026 Medicare Communications and Marketing Guidelines (MCMG) introduced four major changes:

1. **48-hour minimum lead time** between SOA and the sales appointment (with limited exceptions)
2. **12-month retention** of every SOA document, even if no sale occurs
3. **48-hour SOA purge requirement** for unsold leads who do not enroll within the cycle window
4. **Recorded SOAs must include** beneficiary verbal confirmation of every product checked

Failure to produce a valid SOA is the single most common cause of CMS marketing complaints leading to agent termination.

## When Is an SOA Required?

| Scenario | SOA Required? |
|---|---|
| Personal/individual sales appointment | Yes — 48 hr advance |
| Educational event (no products discussed) | No |
| Marketing/sales event (formal) | No (but disclosure required) |
| Inbound call from beneficiary | Yes — verbal at start of call |
| Walk-in to agent office | Yes — completed before discussion |
| Telephonic appointment | Yes — recorded verbal |

## Free SOA Template

CMS publishes a model SOA form (CMS Form 30-2031) at cms.gov. Most agents and FMOs use a customized version that includes their branding while preserving the required CMS fields.

A compliant SOA must capture:
- Product type checkboxes (MA, MAPD, PDP, MedSupp, DSNP, CSNP, ISNP, hospital indemnity, dental/vision/hearing)
- Beneficiary name, address, phone
- Agent name, NPN, agency name
- Date/time/method of appointment
- Beneficiary signature with date
- Disclaimer language

## How unLocked CRM Automates SOA Compliance

The unLocked CRM SOA workflow:
- Sends SOA via SMS/email link the moment a Medicare lead is created
- Captures e-signature with timestamp and IP address
- Stores SOAs for 12 months automatically
- Triggers the 48-hour purge cycle for unsold SOAs
- Pre-fills agent NPN, agency name, and disclosure language
- Logs SOA status on the contact record so the agent never starts a meeting without one
