# CMS 2026 Marketing Rule Changes Explained

## TL;DR

CMS 2026 tightens TPMO disclaimer placement, expands call-recording scope, restricts benefit-forward advertising, and requires re-filing of any lead-gen page that mentions Medicare benefits. Update everything by October 1.

## Key data points

- 70% of 2025 CMS marketing violations were TPMO disclaimer placement issues — the exact area 2026 rules tightened.
- Retention length quadrupled from earlier standards to 10 years under current CMS guidance.

# CMS 2026 Marketing Rule Changes Explained

Every AEP, CMS updates the Medicare Communications and Marketing Guidelines (MCMG). Here's what changed for 2026 and exactly what to update.

## 1. TPMO Disclaimer — Placement Matters
The Third-Party Marketing Organization disclaimer must now appear in the first 60 seconds of any recorded sales call and on every landing page above the fold. Buried footer disclaimers are cited as violations.

## 2. Call Recording — Everything, 10 Years
Every inbound and outbound sales, marketing, and enrollment call must be recorded and retained 10 years. This includes voicemails.

## 3. SOA — 48-Hour Rule
Scope of Appointment must be collected and time-stamped at least 48 hours before an MA/PDP sales appointment. Full breakdown: [SOA compliance 48-hour rule cheat sheet](/blog/soa-compliance-48-hour-rule-cheat-sheet).

## 4. Benefit-Forward Advertising
Ads that lead with dental, vision, OTC, groceries, or giveback must include CMS-compliant framing and the standardized disclaimer. Any page or piece mentioning specific benefits requires re-filing with carriers.

## 5. Lead-Gen Pages
Any web form collecting Medicare-eligible beneficiary info must:
- Disclose TPMO status
- Disclose that not all plans are represented
- Include the standardized 2026 disclaimer
- Store consent with timestamp and IP

## What to Update Before October 1
- Every landing page (disclaimer + benefit framing)
- Every recorded greeting (60-second rule)
- Every Business Reply Card (standardized language)
- Every Facebook / Google / TikTok ad creative
- Your CRM's SOA workflow (48-hour trigger)

unLocked CRM ships CMS 2026-compliant templates and automates the SOA + retention workflow. [See compliance automation](/compliance-automation).
